1月18日，國務院國資委印發(fā)《中央企業(yè)投資監(jiān)督管理辦法》（34號令）和《中央企業(yè)境外投資監(jiān)督管理辦法》（35號令）。國務院國資委表示，34號令和35號令明確出資人投資監(jiān)管底線，也劃定中央企業(yè)投資行為紅線。

China will draw a "red line" that forbids its 102 major State-owned enterprises from investing overseas in real estate, iron ore, petroleum and nonferrous metal, the country's top State-owned assets regulator said on Wednesday.
國資委表示，我國將為102家大型要央企劃定投資紅線，禁止其在海外房地產、鐵礦、石油以及有色金屬領域投資。

The State-Owned Assets Supervision and Administration Commission released two documents to further clarify SOEs' investment direction, procedures, risk control and accountability in domestic and overseas markets.
國有資產監(jiān)督和管理委員會發(fā)布兩份文件，進一步明確央企在國內和海外市場的投資方向、程序、風險管控以及責任劃分。

此次發(fā)布的34號和35號令明確，國資委監(jiān)管的央企投資（SOE investment）是指中央企業(yè)在境內（境外）從事的固定資產投資（investment in fixed assets）與股權投資（equity investment）。

兩個辦法創(chuàng)新性地引入了央企投資項目負面清單制度（negative list system），按類別將投資項目劃分為“禁止類”（sectors that are off-limits）和“特別監(jiān)管類”（sectors with closer supervision），前者央企一律不得投資，列入“特別監(jiān)管類”的需報國資委履行出資人審核把關程序。負面清單之外的項目，由企業(yè)自主決策、自擔責任，國資委按職責加強監(jiān)管。
